SayHala Terms of Service
1 Our agreement
These Terms govern your use of SayHala, including sayhala.com, public profile pages, account tools, private enquiries, booking requests and our related business messaging channel (the "Service"). The operator is ENGAGE MENA FZ LLC, established in Abu Dhabi, United Arab Emirates ("ENGAGE MENA", "SayHala", "we", "us" or "our").
Registered address: P.O. Box 769664, Abu Dhabi, United Arab Emirates
Legal notices: [email protected]
Support and reports: [email protected]
You agree to these Terms when you create an account or affirmatively accept them when submitting an enquiry or booking request. We make them available to visitors, but merely viewing a public page is not a substitute for any affirmative agreement required by law. If you act for a company or other organization, you confirm that you are authorized to bind it; references to "you" then include that organization.
Our Privacy Policy (https://sayhala.com/legal/privacy) explains our data practices. It is a notice about processing, not a waiver of privacy rights. These Terms do not override mandatory consumer or other legal protections. If you do not agree to the Terms, do not register or submit requests through the Service.
2 Eligibility and accounts
You must be at least 18 and meet any higher local age requirement for a binding agreement. You must provide accurate information, have the right to use the phone number supplied, and promptly update information that becomes inaccurate. A business profile must be created by an authorized representative.
You are responsible for reasonable protection of your account and devices. Do not share login codes or allow unauthorized people to use your account. Notify us promptly if you suspect compromise. You are not automatically liable for every unauthorized act regardless of fault; responsibility is subject to applicable law and the circumstances.
Phone verification confirms access to a number, not identity, professional credentials or authority to represent a business. We may use proportionate additional checks for recovery or changes to a private number. Losing access to your number can affect account access; contact support to use an available recovery process.
Registration is self-service. Account creation does not mean that ENGAGE MENA endorses you, has appointed you as an agent, or has approved your products or services.
3 Handles, profiles and verification
You may claim an available handle and publish a Creator, Business or Personal profile. Handles are subject to availability, technical limits and these Terms. You must not impersonate a person or organization, infringe rights, or falsely suggest official affiliation. A handle is a service identifier, not ownership of a domain name, trademark or permanent property right.
We may reserve, refuse or reassign a handle for a demonstrated legal right, impersonation, security issue or other legitimate operational reason. We provide notice and a reasonable chance to choose another handle where appropriate. We do not arbitrarily confiscate a compliant handle to give it to another customer.
You control what you publish. Check links, offers, language and contact information before publishing. Public content can be copied and indexed by others. Do not publish personal information about someone else without authority and a lawful basis.
A verification application is only a request. Unless a badge is actually issued under an announced verification process, the profile is not verified. If we issue a badge, we explain what was checked. Verification is not a guarantee of honesty, service quality, creditworthiness, safety or performance. We may remove a badge where its grounds no longer apply, giving reasons where appropriate.
4 What the Service does
SayHala helps users present profile information and links, receive private enquiries, display featured content or product links, and request bookings. Features may be introduced gradually or limited by location, account type or third-party availability.
At the initial launch, SayHala does not collect customer payments, operate escrow, provide payment protection, guarantee deals, or act as merchant of record for creators or businesses. Linked stores and external payment destinations are operated by their respective providers. A future paid feature requires applicable terms, pricing and other legally required disclosures before purchase.
We are not a party to a campaign, purchase, coaching arrangement, restaurant reservation or other agreement between users unless ENGAGE MENA expressly enters a separate agreement in its own name. An ENGAGE MENA agency engagement has its own agreement and is not created merely by receiving a SayHala enquiry.
5 Private enquiries and contact disclosure
The Service is designed to avoid automatically publishing or sharing private account phone numbers. Enquirers submit the information identified in the interface to the intended recipient. Recipients may accept, decline or ask for more information. A recipient is not obliged to respond or enter a contract.
Accepting an enquiry is permission to continue the enquiry through the available private workflow. It is not, by itself, permission to disclose a private phone number. Contact-detail sharing requires a separate, clearly labelled confirmation from the person whose information is being shared. The interface will explain the information and recipient before disclosure.
You may reveal your own information by typing it into a message, publishing it, or opening a direct-contact link. Once disclosed, another party may copy or retain it. We cannot reverse disclosure already made or control independent off-platform use. Do not share another person's private number or contact details without authority.
Privacy-first does not promise anonymity, absolute confidentiality, end-to-end encryption between SayHala users, or that our systems and authorized service providers cannot process enquiries. Access and handling are explained in the Privacy Policy. You must not use the Service for highly sensitive or regulated confidential communications that require protections the Service does not provide.
Private enquiries are not public posts. Do not publish or use another participant's enquiry content for unrelated purposes without permission or another lawful basis, except where reasonably needed to report abuse, protect rights or comply with law.
6 WhatsApp notifications and third-party limits
WhatsApp is a third-party channel subject to its own terms and policies. SayHala is not affiliated with or endorsed by WhatsApp or Meta merely because it uses the Business Platform. You need a compatible WhatsApp account to receive WhatsApp messages.
We send notifications for the categories you authorize, such as enquiry alerts, booking updates and authentication codes. We do not treat security-code requests as marketing permission. You may change preferences or opt out as described in the Privacy Policy. We provide a support route for problems with automated messages.
WhatsApp notifications may link you to private enquiry details in SayHala. We do not promise that every conversation can take place entirely within WhatsApp, or that we can forward one customer's WhatsApp chat to another customer contrary to provider rules. Delivery may be delayed or prevented by opt-outs, template restrictions, provider outages, device settings or other conditions. A delivery receipt is not proof that the recipient read or agreed to a message.
Ordinary carrier calls and WhatsApp voice calls are separate from the messaging workflow. The Service is not an emergency channel. Use the appropriate emergency services for urgent danger.
7 Sending limits, filtering and unwanted contact
At launch, an enquirer may submit one new initial enquiry to the same recipient in a rolling 24-hour period. Responses in an existing accepted or active enquiry are separate from that initial-request limit, unless additional safety limits apply. We may apply further reasonable limits by account, device or network to prevent abuse and explain material restrictions where practicable.
Do not bypass limits using multiple accounts, numbers, devices or automation. Do not continue unwanted contact after a decline, opt-out or block. A declined enquiry does not authorize repeated contact on another channel.
We use operational filtering and may restrict suspicious submissions. Filtering can produce false positives and false negatives; we cannot guarantee that every delivered message is useful or that all spam is stopped. Report unwanted content or an incorrect restriction to support. We provide a review route for account restrictions and other significant moderation decisions where appropriate or required by law.
8 Booking requests and external products
A submitted booking request is not a confirmed booking unless the relevant business or creator confirms it through the stated process. Availability, capacity, time zones, service descriptions, cancellation conditions, accessibility requirements and other material terms must be made clear by the provider. An automated acknowledgment only confirms receipt of the request unless it expressly states otherwise.
Creators and businesses are responsible for accuracy, required licences, fulfilment, customer support and applicable consumer obligations for their offers. They must clearly disclose whether a product link is an advertisement, sponsorship or affiliate link where required. They must not claim an offer is guaranteed by SayHala when it is not.
Prices, checkout, taxes, delivery, digital-content licences and refunds for an external purchase are governed by the seller's disclosed terms and applicable law. SayHala does not waive a buyer's statutory rights. If payments or digital-file delivery are later enabled directly in SayHala, separate seller and purchase terms will be provided before those features are used.
Adults booking family activities should provide adult contact details and avoid unnecessary identifying information about children. Do not use open enquiry fields to collect medical histories, financial-account details, government ID numbers or other sensitive information.
9 Acceptable use
You must not use the Service to:
- Send spam, bulk unsolicited messages, harassment, threats, stalking, discriminatory abuse or deceptive enquiries.
- Impersonate others, publish misleading claims, run scams, commit fraud or facilitate unlawful activity.
- Post child sexual abuse material, exploitative content, non-consensual intimate material or other unlawful sexual content.
- Disclose private information without authority; scrape phone numbers; attempt to reveal private numbers; or use information received for unauthorized marketing.
- Infringe intellectual-property rights, publish unlawful defamatory content or violate another person's rights.
- Upload malware, steal credentials, bypass access controls or interfere with service availability.
- Scrape, harvest or bulk-extract profiles or enquiries using unauthorized automation; evade limits; or create deceptive accounts.
- Promote or facilitate restricted goods or services through a channel where prohibited by law or provider rules, including prohibited weapons, drugs, tobacco, alcohol, gambling, adult services or other restricted categories.
- Collect highly sensitive information through workflows not approved for that purpose, or misrepresent the Service as a regulated secure communications system.
You may report security issues in good faith through our support contact without exploiting them or accessing others' information. You must comply with the laws applying to your activities and the relevant third-party platform policies.
10 Content ownership and our limited licence
You retain ownership of your content and existing intellectual property. You confirm that you have the rights and permissions needed to upload, publish and share it, including image rights and permissions from people depicted.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, technically adapt, display and transmit your content only as necessary to operate the features you request, provide support, maintain security and comply with lawful obligations. Public-profile content may be displayed publicly; private enquiries are transmitted only for the purposes described in the Privacy Policy. We may allow contracted providers to perform those tasks under appropriate restrictions.
This licence is not permission to sell your content, use private messages for agency marketing, train generative AI models on your content, or feature you in unrelated promotional campaigns. Separate permission is required for a materially different use where applicable.
The operational licence ends when the relevant content is deleted, except for limited backup rotation, copies already delivered to intended recipients, and lawful retention described in the Privacy Policy. Independent recipient copies are not controlled by this licence.
11 SayHala intellectual property
ENGAGE MENA or its licensors own the Service software, branding, templates and other platform materials, excluding user content and third-party materials. You receive a limited right to use the available Service features under these Terms. You may share your public profile link and use supplied sharing assets for their intended purpose.
Do not copy or commercially exploit the platform, falsely claim our endorsement, or use our branding in a confusing way. Restrictions on reverse engineering or similar activities apply only to the extent permitted by law and do not remove statutory rights or rights under an applicable open-source licence.
12 Reports, moderation and appeals
Report abuse, privacy concerns or intellectual-property complaints to [email protected]. Include the relevant URL or enquiry reference, a description and reasonably necessary supporting evidence. Do not include unnecessary sensitive data. A rights complaint should identify the protected work or right and your authority to act.
We may investigate, restrict delivery, remove content, suspend accounts or take other proportionate measures where content violates these Terms, threatens safety, breaches law or provider requirements, or creates material security risk. We may act immediately for urgent danger or legal requirements. Where lawful and appropriate, we notify the affected user, explain the reason and provide an opportunity to appeal. We may withhold details where disclosure would endanger others, compromise an investigation or be unlawful.
Appeals can be sent to the support contact. We review them reasonably and correct mistakes where established. We retain the records needed for handling reports only as described in the Privacy Policy. False or malicious reports may themselves violate these Terms.
13 Fees and future paid features
The initial profile and enquiry service is offered without a SayHala subscription fee unless a clearly disclosed offer states otherwise before you sign up. Your carrier or third-party provider may charge its own fees. We do not charge you merely because Meta charges us to deliver a service message.
We may introduce optional paid plans or features. Before you purchase, we will disclose price, currency, tax treatment, billing frequency, renewal, cancellation and refund terms, and obtain the acceptance required by law. A free account will not silently become a paid subscription. Statutory withdrawal, refund and consumer rights continue to apply.
14 Availability and changes
We aim to provide a useful and reliable service, but we do not guarantee uninterrupted access, delivery of every notification or successful commercial outcomes. Maintenance, network failures and third-party restrictions can affect availability. We may alter features for security, technical, legal or operational reasons. We give reasonable notice of changes that materially affect existing users where practicable and legally required.
We do not guarantee a particular number of enquiries, followers, bookings, sales or campaign opportunities. Verification and filtering do not remove the need for users to assess counterparties and offers.
Where the law implies warranties or service standards that cannot be excluded, those protections apply. For consumers, these Terms do not exclude our duty to provide the Service with legally required care and skill or other non-excludable obligations.
15 Responsibility and limits of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, deliberate misconduct, or death or personal injury caused by negligence where the applicable law prohibits exclusion, or your mandatory consumer and privacy remedies.
Subject to those protections, we are not responsible for an independent user's performance, external store fulfilment or a third-party service's conduct solely because it is linked from SayHala. We remain responsible for our own acts and omissions to the extent required by law.
For a user acting wholly or mainly for business purposes, and only where lawful, our total liability arising from the Service during a 12-month period is limited to the greater of AED 1,000 and the SayHala fees that user paid during that period. This limit does not apply to liabilities that cannot be limited under law or the exclusions stated in the first paragraph. To the extent lawful for business users, we exclude indirect or consequential losses and lost profits arising from use of the Service. This paragraph does not impose that contractual cap on consumers where consumer protections prohibit it.
Consumers retain remedies required by applicable law. Any limitation in these Terms applies only to the extent it is fair and enforceable in the circumstances. We do not require you to waive statutory rights because the Service is free.
16 Business-user claims
If you use the Service for business purposes, you are responsible for unlawful content and activities you control. To the extent permitted by law, you agree to reimburse reasonable amounts finally awarded or settled with your approval for a third-party claim directly caused by your material breach, unlawful content or infringement, excluding amounts caused by our own wrongdoing. We must promptly notify you of the claim, allow reasonable participation in its defence and not agree to a settlement imposing obligations on you without your consent. This clause is not a blanket indemnity imposed on consumers.
17 Closing an account or ending access
You may close your account using available account controls or request closure through support. We process deletion and retention under the Privacy Policy. Closure does not cancel an independent booking or agreement with a creator or business; contact that provider separately.
We may suspend or end access for a serious or repeated breach, unlawful activity, security risk, or a legal or provider requirement. We provide reasons and an appeal route where appropriate. For a remediable non-urgent issue, we ordinarily give a reasonable opportunity to correct it. We may discontinue the Service with reasonable advance notice where practicable and give an opportunity to obtain information to which you are entitled.
Ending access does not affect accrued lawful obligations or the clauses that by their nature remain relevant, including intellectual property, lawful retention, dispute handling and responsibility for prior conduct.
18 Governing law and disputes
Subject to mandatory laws and rights applicable to you, these Terms are governed by the laws applicable in Abu Dhabi, United Arab Emirates, and disputes fall within the jurisdiction of the competent Abu Dhabi courts.
If you are a consumer, this choice does not remove mandatory protections of your country of habitual residence, any right to bring proceedings in a competent local court, or any other non-waivable right. We do not impose mandatory arbitration or a class-action waiver through these Terms.
Please first contact [email protected] so we can attempt to resolve a concern. This is not a condition that prevents urgent proceedings, regulatory complaints or exercise of statutory rights.
19 Updates and general provisions
We publish updated Terms at this URL and identify the effective date. We give reasonable advance notice of material changes where required and obtain fresh agreement where required by law. Changes are not retroactive to accrued disputes or completed transactions. If you do not agree to a material change, you may stop using the Service and close your account, subject to accrued obligations and mandatory rights.
If a clause is unenforceable, the remainder applies to the extent lawful. A failure to enforce a clause once is not a permanent waiver. You may not transfer an account in a way that compromises security or others' rights. We may transfer this agreement as part of a lawful corporate transaction only where it does not reduce mandatory protections; we provide required notice.
These Terms and any feature terms expressly accepted by you govern use of the Service. They do not displace a separate signed ENGAGE MENA agreement. If a translated version is supplied, we identify its status; no language-priority rule overrides mandatory local-language or consumer requirements.
For questions, notices, reports and appeals, use the contacts in Section 1.
